COTTAGE CHEESE SAYS THE JUDGE!

California Judge Ross Bigler has been routinely dismissing seat belt violations on the grounds that the "law is like eating cottage cheese," it may be good for a person but the government cannot require it. "The people have the right to make the decision (on seat belts) for themselves," he said.

Although the California Legislature passed a law that requires drivers and their passengers to wear seat belts, the Siskiyou County judge has ruled that the law is an unconstitutional interference with personal rights, and also said that seat belts could be dangerous. If he had been strapped in his car during an auto accident five years ago he would not have survived. He said he was spared because he was thrown underneath the dashboard.

According to Judge Bigler, lawmakers cannot legally make "... a law saying everyone must conform just because it's good for you." The judge wrote an opinion on the seat belt law that he provides to alleged offenders before dismissing the charges.

"There are those who think that eating cottage cheese is good for you ... therefore, since there are those who don't agree, we must have a law that people eat cottage cheese each day." (Yuck!)

I think Judge Bigler is absolutely right. I don't like cottage cheese either and even though it may be good for me, I don't want the politicians to make me eat it!
